TERMS OF SERVICE

1. AGREEMENT TO OUR LEGAL TERMS

We are LeHa Design GmbH ("Company," "we," "us," "our"), a company registered in Austria at Gadenweith 15, 2565 Neuhaus, Austria.

We operate the website https://www.lehadesign.club/ (the "Site"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services"). We provide a premium 3D model marketplace for makers, offering digital files (STL, 3MF) for 3D printing.

These Legal Terms constitute a legally binding agreement made between you ("you") and LeHa Design GmbH. By accessing the Services, you agree that you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, YOU ARE PROHIBITED FROM USING THE SERVICES.

2. THE SERVICES & DIGITAL GOODS

Our Services allow users to browse, unlock, and download premium 3D models.

• Nature of Goods: All products are strictly digital downloads (STL, 3MF files). There is no physical shipping. Files are hosted via Cloudflare R2.
• Intellectual Property: All models are the intellectual property of LeHa Design GmbH. Your purchase or subscription grants you a license to use these models as defined in our License Agreement.
• Account Requirement: You must register an account to purchase keys or subscriptions. Each user is permitted only one account.

3. THE KEY SYSTEM

Access to digital models is managed through a "Key" system:

• Unlocking Models: One key is used to "unlock" one model. Once a model is unlocked, the user has permanent access to download that specific file via their account dashboard.
• Subscription Key Allocations: Based on your tier (Starter, Builder, Pro), you receive a set allocation of keys.
  • Monthly Distribution: Both monthly and annual subscriptions receive their key allowance on a monthly basis.
  • Carry-Over (Active Subscription Required): Unused subscription keys carry over from month to month only while your subscription remains active. The carry-over is a benefit of continuous membership and is not a stored credit.
  • Expiration on Cancellation: If your subscription is cancelled, lapses, or is terminated for any reason, all unused subscription keys expire immediately and are forfeited without refund or compensation.
• Single-Purchase Keys: Keys purchased individually (outside of a subscription) never expire and remain on your account until used, independent of your subscription status.

4. PURCHASES AND PAYMENT

Payments are processed through LemonSqueezy, a third-party payment processor and Merchant of Record.

• Subscriptions: Subscriptions are available on monthly or annual plans and will auto-renew at the end of the term.
• Annual Plans: Users on annual plans are billed once per year but receive their key allowance in monthly increments throughout the duration of the year.
• Upgrades: You may upgrade your subscription to a higher tier at any time via your account settings. Upgrades take effect immediately.
• No Downgrades: Downgrading an active subscription to a lower tier is not possible. If you wish to move to a lower tier, you must first cancel your current subscription (at which point all unused subscription keys expire — see Section 3 and Section 5) and, after your current paid period ends, subscribe to the lower tier as a new subscription.
• Cancellation: You can cancel your subscription at any time via your account settings. See Section 5 for the effects of cancellation.

5. CANCELLATION

You may cancel your subscription at any time via your account settings.

• Future Billing: Cancellation stops any future recurring charges. No partial refunds are issued for the current billing period.
• Immediate Expiration of Subscription Keys: Upon cancellation, all unused subscription keys on your account expire immediately and are forfeited without refund. This includes both keys from the current billing cycle and any keys that have carried over from prior cycles. Carry-over is a benefit of an active subscription only.
• Single-Purchase Keys Unaffected: Keys purchased individually (outside of a subscription) are not affected by cancellation and remain on your account.
• Persistent Access to Unlocked Models: You will retain permanent download access to any models you have already unlocked with a key prior to cancellation.
• No Downgrades: As noted in Section 4, downgrading to a lower tier is not possible. Users who wish to move to a lower tier must cancel first (thereby forfeiting their unused subscription keys) and resubscribe to the desired tier as a new subscription.

6. REFUND POLICY (EU CONSUMER RIGHTS)

Due to the nature of digital content, all sales are final.

• Loss of Right of Withdrawal: Under EU consumer law, the 14-day right of withdrawal for digital goods expires once performance has begun. By "unlocking" a model or initiating a download, you expressly consent to immediate performance and acknowledge that you lose your right to a refund for that purchase or subscription.
• Withdrawal Before Unlocking: If you have not unlocked any model yet and are still within the 14-day period, you may withdraw by completing the Model Withdrawal Form in our Cancellation Policy and emailing it to hello@lehadesign.at. We will process the refund once we verify that no models have been unlocked.
• Defective Files: If a file is technically defective (corrupted) and cannot be repaired by us, we will provide a credit or refund in accordance with Austrian statutory warranty laws (Gewährleistung).

7. PROHIBITED ACTIVITIES

As a user, you agree not to:

• Share, sell, or distribute the digital files (STL/3MF) to any third party.
• Create multiple accounts to exploit promotional offers or trial periods.
• Use automated systems (bots, scrapers) to download content from the Site.
• Attempt to reverse engineer or decompile the 3D files.

8. GOVERNING LAW & DISPUTE RESOLUTION

8.1 Governing Law

These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of Austria, without regard to its conflict of law principles.

8.2 Jurisdiction

For consumers, the statutory places of jurisdiction apply. For business-to-business transactions, the competent court in Wiener Neustadt, Austria shall have exclusive jurisdiction.

8.3 Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find at: https://ec.europa.eu/consumers/odr.

9. LIMITATIONS OF LIABILITY

LeHa Design GmbH provides files "as is." To the extent permitted by Austrian law, we are not liable for:

• Damages to 3D printing hardware or wasted materials (filament, resin) resulting from the use of our files.
• Service interruptions due to maintenance or third-party provider failures (e.g., Cloudflare, LemonSqueezy).

10. USER-GENERATED CONTENT ("MAKES")

Our Services allow you to upload photos, videos, or other content showcasing your 3D prints ("Makes"). By uploading content, you agree to the following:

10.1 License Grant

By uploading content, you grant LeHa Design GmbH a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, display, reproduce, modify, and distribute your content in connection with our Services, including for marketing, promotional, and social media purposes. This license continues even if you delete your account or content.

10.2 Ownership

You retain ownership of the content you upload. However, by uploading, you represent and warrant that you own all rights to the content or have obtained all necessary permissions to grant us the license above.

10.3 Content Standards

You agree not to upload content that:

• You do not have the right to share or that infringes any third-party intellectual property rights.
• Contains identifiable persons without their explicit consent.
• Is illegal, defamatory, threatening, harassing, obscene, or otherwise objectionable.
• Contains malware, viruses, or any harmful code.
• Is spam, advertising, or commercial solicitation unrelated to LeHa Design Club.
• Misrepresents your identity or affiliation with any person or entity.

10.4 Content Removal

We reserve the right, but have no obligation, to monitor, review, or remove any user-generated content at our sole discretion, without notice, for any reason, including but not limited to violation of these Terms or if the content is otherwise harmful to us or third parties.

10.5 Copyright Infringement Claims

If you believe that content on our Site infringes your copyright, please contact us at hello@lehadesign.at with the following information:

• Identification of the copyrighted work you claim has been infringed.
• Identification of the infringing material and its location on our Site.
• Your contact information (name, address, email, phone number).
• A statement that you have a good faith belief that the use is not authorized by the copyright owner.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

10.6 Disclaimer

User-generated content does not represent the views, opinions, or endorsement of LeHa Design GmbH. We are not responsible or liable for any user content or any claims, damages, or losses resulting from the use of or reliance on such content. You acknowledge that you may be exposed to user content that is inaccurate, offensive, or otherwise objectionable.
